PinSpec Terms of Service

Introduction

These Terms of Service (“Terms”) constitute a legal agreement between you and PinSpec Pte. Ltd. (“PinSpec,” “we,” or “us”) regarding your access to and use of pinspec.ai (the “Site”) and any products, tools, and services made available on or through the Site (collectively, the “Services”).

By accessing or using the Site and our Services, you agree that you:

• Confirm that you have read, understood, and accepted these Terms and Conditions (“Terms”).
• Agree to comply with our Privacy Policy.
• Commit to following all applicable laws and regulations.

If you do not agree to these Terms, you must not use our Services.

License to Use Our Services

Subject to these Terms, PinSpec grants you a limited, non-exclusive, non-transferable, revocable license to use our Services, including for personal and commercial purposes, in accordance with your subscription plan and these Terms.

Intellectual Property Rights

Our Rights

PinSpec retains all rights, title, and interest in and to the following:

• Brand Elements:

  • The “PinSpec” name, logo, and associated branding
  • The “pinspec.ai” domain name and all related domains and variants
  • All “PinSpec” designs and visual elements
  • All marketing materials and website content

• Platform & Codebase:

  • All proprietary algorithms, models, systems, and functionalities
  • User interface design, site architecture, and platform structure
  • All documentation, training materials, and support content

• Website Content:

  • Text, graphics, UI components, blog posts, and all other media

These elements are protected under copyright, trademark, patent, and other intellectual property laws.

Your Rights

You retain full rights and ownership to:

• Code generated using our Services
• Applications and solutions built with PinSpec
• Your own business logic, architecture, and configurations
• Modifications or derivative works of generated code

You may freely:

• Use, modify, and distribute generated code
• Combine it with other tools or assets
• Open-source your work
• Sell applications built using PinSpec tools
• Use it without attribution or royalties

Data Usage, Training & Learning

Platform Improvement

We collect and analyze data (including prompts, usage logs, and generated content) to:

• Improve platform performance and code generation quality.
• Identify usage patterns and optimize service delivery.
• Detect bugs and enhance system reliability.
• Support AI training and product improvement (except for Enterprise users).

This data is processed responsibly and used to:

• Train and refine our AI systems, improving their ability to understand developer requirements and generate appropriate code
• Enhance the quality and accuracy of code generation through pattern analysis and learning
• Optimize platform performance based on real-world usage patterns
• Identify and resolve technical issues through systematic analysis
• Develop new features and capabilities based on user needs and behavior

Enterprise Data Policy

For Enterprise plans:

• No data is used for training by default
• Custom data handling agreements are available
• No sharing with third parties without explicit consent

Data Retention

• Data is retained only as necessary for platform improvement and operations.
• You may request deletion of your data, subject to technical feasibility.
• Some data may be retained for legal compliance.

Accounts and User Content

Account Management

• You may create an account to access Services
• You are responsible for maintaining your account security
• Account deletion must be requested via official@pinspec.ai
• We reserve the right to terminate accounts that violate these Terms

Content Responsibility

You may upload or submit:

• Code
• Images, videos, fonts
• Other digital content

By uploading, you affirm:

• You own or have rights to the content.
• The content does not infringe on third-party rights or violate laws.
• You bear sole responsibility for your content.

Services, Pricing, and Support

Plans and Limits

• Free plan: 5 messages per day, 30 messages per month
• Paid plans: As described at [https://pinspec.ai/pricing]
• Message limits reset at the start of each month
• We reserve the right to modify plans and pricing at any time

Support Services

• Available to Scale and Enterprise users
• Contact: official@pinspec.ai
• Support limited to platform-related issues only

Subscription Terms

• Subscriptions auto-renew monthly
• No annual plans unless stated
• Immediate access upon payment
• Payments are non-refundable unless otherwise decided by PinSpec

Refund and Cancellation Policy

Refunds

Refunds are generally not provided, except:

• Billing errors
• Duplicate payments
• Other cases at our sole discretion

Refunds will be processed and issued to the original payment method.

Cancellation

To cancel your plan:

1. Go to your Profile
2. Select Plans & Billing
3. Click Manage Subscription
4. Choose Cancel

You can cancel your subscription via your Profile under Plans & Billing. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You will continue to have full access until the end of your paid period
• Your subscription will not automatically renew after cancellation
• Any unused message credits expire at the end of the subscription
• No partial refunds are provided for unused portions of the billing period

Digital Services Notice

PinSpec provides a digital service; as such:

• Traditional return/refund rules do not apply
• All purchases are final unless stated otherwise

DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). For any DMCA-related issues, contact us at official@pinspec.ai with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material
• Your contact information
• A statement of good faith belief in infringement
• A statement of accuracy under penalty of perjury

Prohibited Uses

You may not:

• Reverse engineer, decompile, or tamper with our platform.
• Use bots, scrapers, or other automated tools without permission.
• Access unauthorized parts of the system.
• Create multiple free accounts to bypass limits.
• Use PinSpec for any unlawful, harmful, or malicious purpose.
• Upload malicious files or attempt to disrupt system functionality.

PinSpec is prohibited for use in or by entities subject to sanctions or export restrictions under any applicable jurisdiction.

Promotions and Feedback

• Promotions, sweepstakes, or contests may carry additional terms.
• Feedback provided to PinSpec may be used without compensation.
• By submitting feedback, you grant us a perpetual, worldwide, royalty-free license to use and incorporate it.

PinSpec Services and content are provided “as is” without warranty.

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee:

• Code quality, completeness, or compatibility
• Continuous access or error-free service
• Security or privacy of uploaded/generated content

Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PINSPEC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• Accuracy or completeness of generated code.
• Suitability of generated solutions for specific purposes.
• Those services will be uninterrupted or error-free.

YOU USE THE PLATFORM AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINSPEC SHALL NOT BE LIABLE FOR:

• Direct, indirect, incidental, special, consequential, or exemplary damages.
• Loss of profits, goodwill, data, or business opportunities.
• Damages arising from use of or reliance on generated code or service interruptions.
• Third-party service issues or dependency failures.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PINSPEC IN THE 12 MONTHS PRIOR TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless PinSpec and its affiliates from any claims, damages, or liabilities arising from:

• Your use of our services.
• Your violation of these Terms.
• Your content or your products built using our platform.
• Any third-party claims related to your use of the Services.

Legal Jurisdiction

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

All disputes shall be resolved exclusively by the courts located in Singapore, and you consent to the jurisdiction of these courts.
